Carinski postopek 42 in klavzula INCOTERM DDP

Zaznali smo nepravilnosti pri izvajanju carinskega postopka 42 in napačno uporabo klavzule INCOTERM DDP, zato v nadaljevanju podajamo podrobnejša pojasnila. 

Klavzula pomeni »Delivered duty paid«, kar pomeni »dobavljeno, dajatve plačane«. Uporaba te klavzule običajno pomeni, da prodajalec organizira celoten prevoz do dogovorjenega kraja v državi kupca, nosi vsa tveganja ter plača vse stroške, vključno s carino in davki (DDV). Kupec pa prevzame blago na dogovorjenem kraju in nima obveznosti glede carinskih formalnosti ali plačila dajatev. 

Carinski postopek 42 pomeni sprostitev blaga v prosti promet in plačilo carinskih dajatev, pri čemer se pri uvozu odobri oprostitev plačila DDV, ker bo uvoznik izvedel dobavo blaga v drugo državo članico. To pomeni, da vse davčne obveznosti v zvezi z DDV pri carinskem postopku 42 izvede uvoznik. 

Pri uporabi klavzule DDP plača stroške, carino in DDV prodajalec, pri carinskem postopku 42 pa kupec, ki je običajno v carinski deklaraciji naveden kot uvoznik. Glede na navedeno se pri carinskem postopku 42 ne more uporabiti klavzule DDP. Izjema bi bili samo primeri, ko bi bil izvoznik hkrati uvoznik, ki bi izvedel dobavo blaga v drugo državo članico.
