UPRS Sodba I U 790/2023-9

Davčni organ ni ugotavljal, ali so izpolnjeni pogoji iz drugega odstavka 29. člena ZDDPO-2 za davčno nepriznanje odhodkov, torej da so bili knjiženi dohodki nepotrebni oziroma niso bili uporabljeni s ciljem ustvarjanja prihodkov. Tega ni ugotavljala niti toženka v drugostopenjski odločbi, čeprav se sklicuje tudi na 29. člen ZDDPO-2. Davčni organ sicer na več mestih podvomi, ali so bile zaračunane storitve res opravljene, vendar odločitve ne utemelji na tem stališču (torej da odhodki sploh niso nastali), ampak na stališču, da tožnica ni zagotovila ustreznih listin o odhodkih, katerih obstoj ni sporen. Čim je temu tako, lahko ostaja odprto zgolj vprašanje višine nastalih odhodkov in njihove potrebnosti za tožničino poslovanje, ne pa vprašanje, ali so storitve montaže sploh bile opravljene. Obdavčitev obdavčljivih vrst dohodka ZDoh-2 ureja izrecno v posameznih, temu namenjenih poglavjih. Posamezen dohodek je mogoče opredeliti kot drug dohodek, če se...
